They manage all phases of the litigation from the investigation, pleadings, and discovery through the pre-trial, trial, settlement, and appeal processes. Tasks can vary based on the nature of the dispute, the experience of the attorney, and whether hes representing the plaintiff or the defendant. Education and Training A litigation lawyer must have achieved her juris doctor degree from a law school accredited by the American Bar Association. It means first earning a four-year degree in addition to three additional years in law school. Attorneys must then pass the bar exam and be admitted to the bar in the state in which they wish to practice. Its often helpful to be admitted to the bar in neighboring states as well for a wider potential client base and increas ed job opportunities. Initial Case Assessment and Investigation Litigation attorneys in a plaintiffs case often conduct an initial case investigation to determine if enough evidence exists to warrant filing a lawsuit. In a defendants case, hell assess what evidence exists to defend a potential or existing suit against his client. The investigation process can include locating witnesses, taking witness statements, gathering documents, interviewing the client, and investigating the facts leading to the dispute. Litigation attorneys often engage in pre-litigation settlement discussions to attempt to resolve the matter before a lawsuit is filed. The Discovery Process The discovery portion of a lawsuit involves the exchange of all relevant information between the parties. Litigation attorneys employ a variety of discovery devices to gain this information. These methods can include interrogatories, a series of written questions that the other party to the lawsuit must answer- also in writing and under penalty of perjury. It can include depositions which involve oral questions typically presented by the other attorney in an office setting, again answered under oath. Other common methods of discovery include requests for documents that are in the possession of the other party as well as requests for admission- asking the other party to admit to or deny certain aspects of the case in writing and under oath. Litigation attorneys might also examine physical evidence and collect, process, and analyze information gathered during e-discovery. Most often, however, they rely on experts to provide these services. The experts submit written reports that can then be used at trial or they might be called to testify at trial. Litigation attorneys also draft and argue discovery-related motions including motions to compel the other side to respond to discovery requests if they havent done so within a specified time period. These discovery processes help litigators gain relevant information, identify issues, and formulate a case strategy. Pre-Trial Tasks The weeks immediately preceding trial are a time to wrap up discovery and prepare for court. Litigators consult with and advise clients, retain expert wit nesses, attend pre-trial conferences, and develop trial strategies based on the facts and evidence. They might also conduct pre-trial depositions of experts and key witnesses, prepare demonstrative evidence to be used as trial exhibits, and draft and argue pre-trial motions such as those dealing with the admissibility of certain evidence at trial. Trial Almost the Final Stage When cases proceed to trial, litigation attorneys are busy around the clock presenting their case before the judge or preparing for the next day in court. Litigators collaborate with experts and clients to craft a trial theme. They identify the strengths and weaknesses of a case and develop persuasive arguments. They prepare witnesses and their clients for testimony. A process called voir dire begins a trial. It is the process of selecting a jury. Litigators then present their cases in court, giving opening and closing statements to the judge or jury, examining and cross-examining witnesses, and crafting th eir version of the case through testimony and evidence. Litigation attorneys might also conduct post-trial interviews of the jury. The Possibility of Settlement Most cases never reach trial but instead are settled to eliminate the risk and expense of going to court. Litigation attorneys can settle a case at any time during the life cycle of a lawsuit. Litigators will engage in negotiations with opposing parties and sometimes participate in mediation and settlement conferences with the judge. Theyll create settlement brochures, agreements, releases, and other materials to memorialize any agreement thats reached. The Appeals Process An attorney might appeal the case for her client if the trial goes badly, but he cant do so simply because she doesnt like the outcome. She must present evidence as to why the trial courts decision was wrong in some way based on issues such as certain evidence being admitted at trial when it should not have been. Litigators might draft post-trial m otions, identify and preserve issues for appeal, develop appellate strategies, gather evidence for the appellate record, research procedural issues, draft appellate documents, and present oral arguments before appellate courts. If the case is particularly significant or complex, litigators might retain the assistance of attorneys who specialize in appellate practice.

In the recent book, Dollars and Sense How We Misthink Money and How to Spend Smarter, behavioral economist Dan Ariely, and co-author Jeff Kreisler break down some of the reasons were just so stupid about spending.In an interview with CNN Money about trying to fix our spending, Ariely said, We can wait for someone to solve it for us, or you can try to do your own financial hacking yourself.Here are some spend less hacks worth thinking about1) Stop making it so easyIf buying that needless widget meant there was more of a pain p oint involved in the process, we might elend do it quite that often or quite that easily. But since its easier than ever to buy, we do. Try disconnecting auto pay from your accounts. Or give yourself a new accountability tool. What if you had to post every single spend on your Google calendar and highlight it in red? Spend shaming might really become a thing.2) Highlight your savings not spendingAriely mentions that while we share every detail of our shopping lives online or with friends, we dont spend that much time talking about how much weve saved or invested. Maybe its time to seriously change that collective conversation.3) Stop going digitalBelieve it or not, while paying your bills automatically may seem like the best approach, you might be making it way too easy to overspend. In the CNN Money article, Ariely advises cutting down on digital spending and instead starting to pay attention to larger costs. Another tip he offers is using a pre-paid debit card and loading it up on Mondays, so you can best prepare for the week ahead.But its not all bad news on the spending front. Personal finance expert KyleNakatsuji, CEO and founder of auto insurance startup Clearcover, said that not all of us have become less mindful of how we spend in fact, in some ways, were more mindful of how we spend.With advances in financial technology related to planning, budgeting and analysis, theres an increasing amount of information available to help us make better money-saving decisions, Nakatsuji says. But somehow, we dont seem to be making those smarter decisions.These same kinds of advances have also made it easier than ever to spend money, and continue to spend it. Most things people think of as stupid are unnecessary purchases while we think its equally silly to overpay for things youre required to have like car insurance. In fact, saving money on things youre forced to purchase can create the financial freedom to rationally buy the other things you really want, meaning youll naturally make fewer bad decisions.Dont blame it on MillennialsThough it can be easy to blame digital natives for rampant online spending habits, it isnt quite that black or white (or lack of green). I think spending habits vary more by the rolle than by demographic because people are intrinsically motivated in similar ways despite their age, Nakatsuji said. For me, its more about the personality than the group. Youll find people across the different generations who place a high value on material goods or experiences (and there fore may spend more freely), just as youll find a mixed range of people who value frugality.For that reason, its also wise to try to spend less based on your personality type and spending inclinations, rather than the generational labels.

Air Force Enlisted Promotions Made SimpleAir Force Enlisted Promotions Made SimpleCongress sets the size of the active duty force for each branch of the service and sets the percentage of the enlisted force that is allowed to serve in each paygrade, above the grade of E-4. That meansfor someone to be promoted to E-5 or above, there must be a vacancy. Such vacancies are created when someone separates, retires, or gets promoted to the next grade. Depending upon the defense budget in a given year, it can be easier or more difficult to join the military or advance in rate. The usual requirements to versetzung are a good performer who does his/her job without getting into trouble (work or personal life) and has the Time in Service (TIS) and Time in Grade (TIG). However, with the WAPS and STEP program of the Air Force high performing members can advance quicker than their peers in the saatkorn rank, grade, year group. Airman (E-2) to Senior Airman (E-4) Promotions Just like the Army, t he unit commander is the promotion authority for promotions to Airman (E-2), Airman First Class (E-3) and Senior Airman (E-4). As long as a person doesnt get into trouble, and does their job satisfactorily, promotions up to E-4 are automatic, based on Time-in-Service (TIS) and Time-in-Grade (TIG). The TIG/TIS requirements are Airman (E-2) - Six months TIG as an Airman Basic (E-1) After six months in the Air Force, advancement to E-2 Airman is automatic as long as the member has adjusted well to the Air Force way of life and understands his/her Air Force Occupational Specialty. This six months typically covers the time in Basic Military Training and Technical Training. Airman First Class (E-3) - Ten months TIG as an Airman (E-2) After ten months as an Airman - a total of 16 months in the Air Force, advancement to E-3 is dependent upon the mastering of the job specialty, setting an example to subordinates, and staying out of trouble (work and personal). Senior Airman (E-4) - 36 months TIS with 20 months TIG, or 28 months TIG, whichever occurs first. Development from a junior enlisted member to becoming a Non-Commissioned Officer (NCO) is the process the advancement process considers when advancing a member to E-4 - Senior Airman. Typically, it takes three years to advance to E-4, but it can be faster depending upon enlistment contract, pre-military college, and other programs. A Faster Way to E-4 The Air Force offers programs for selected enlisted personnel to enlist at an advanced rank, for things such as college credits orparticipation in Junior ROTC. The highest advanced rank one can enlist with under ansicht programs is Airman First Class (E-3). The Air Force is the only service that gives an accelerated promotion for those who agree to enlist for six years. Under this program, a recruit joins asan Airman Basic (E-1), is promoted to Airman (E-2) after graduating basic training, and advances to Airman First Class (E-3) upon graduation fromtechnical school , or 20 weeks after graduation from basic training, whichever occurs first. Senior Airman (E-4) Below-the-Zone The Air Force has a special program where commanders can promote a limited number of outstanding Airman First Class (E-3) to Senior Airman (E-4) six months before they would otherwise be eligible. This program is known as the Senior Airman Below-the-Zone Promotion Program. Primarily, commanders decide who will be promoted under the program by means of a promotion board. Large units (those with 7 or more eligible for promotion) can conduct the promotion boards in-house and select up to 15 percent for early promotion. Small units (6 or fewereligible) are combined into one pool of eligible to form a central base board (CBB). WAPS Points in the Air Force Assuming the individual is eligible for promotion, based on TIS/TIG/skill level, and is recommended for promotion by the commander, then the WAPS points come into play. Various factors concerning the member are worth prom otion points. Those with the most WAPS points within the AFSC are the ones selected for promotion Promotion Fitness Examination (PFE)- This is a 100 question test about Air Force general supervisory subjects, such as history, leadership, NCO responsibilities, first aid, customs, and courtesies, etc. The maximum number of points that can be awarded is 100. Specialty Knowledge Test (SKT)- This is a 100 question test about the individuals job in the Air Force.The maximum number of points that can be achieved from the SKT is 100. Time-in-Grade (TIG)- Air Force members are awarded one-half of a point for each month they have time-in-grade. The maximum numberof TIG points is 60. Time-in-Service (TIS) - Members are awarded two points for each year they have in the military. The maximum numberof TIS points is 40. TIG and TIS are being phased out or not counted as high with the new changes compared to the above test scores and overall performance and reports. Awards and Decorations- Just lik e the Army, Air Force members receive promotion points if awarded certain military decorations (medals). The maximum number of decoration points is 25. Enlisted Performance Reports(EPR) - Changes in recent years have been made to this part of the WAPS equation Only the three most recent EPRs are used in promotion calculations. The WAPS test results are added to the EPRs, service and grade times and decorations, the top 60 percent of applicants within each Air Force specialty code will have their records sent to an evaluation board. Staff Sergeant (E-5) to Master Sergeant (E-7) Promotions In the Air Force, selections for promotions at unterstellung ranks are made using a weighted airman promotion system or WAPS. The Air Force is allowed to award five extra percentage points to AFSCs it considers critically-manned. So, if the overall promotion rate for E-5s is 25 percent, the Air Force could promote 30 percent of any AFSC it considers to be seriously undermanned. After the Air For ce determines what the promotion-rate is going to be overall, airmen have to be eligible for promotion, based on the skill level theyve received in their jobs, TIG/TIS, EPRs, and scores on advancement tests. Skill levels are based on On-the-Job (OJT) training requirements, completion of job-school, and/or completion of a job correspondence course. Air Force Skill Levels 1-Level.Untrained. Designates individuals who are in basic training and/or technical school.3-Level.Apprentice. The 3-skill level is awarded after graduation from technical school.5-Level.Craftsman. The 5-skill level is awarded after a period of OJT, and completion of CDCs, after arrival at the first duty assignment. While it varies based on the complexity of the job, it takes most people about 18 months to earn their 5-skill level.7-Level.Supervisor. When a person is promoted to Staff Sergeant (E-5), then enter into 7-level training. This is accomplished via OJT, and (usually) graduation from a 7-level job-schoo l. Sometimes, there is no available job-school, and upgrade is accomplished by completing 7-level CDCs. 9-Level.Manager. Skill-level assigned to E-8s and E-9s. For promotions to the grades of E-5 to E-7, the TIS/TIG and skill-level requirements are Staff Sergeant(E-5) - Three years TIS, six months TIG, and awarded the 5-skill levelTechnical Sergeant(E-6) - 5 years TIS, 23 months TIG, and awarded the 7-skill levelMaster Sergeant(E-7) - 8 years TIS, 24 months TIG, and awarded the 7-skill level Senior Master Sergeant (E-8) and Chief Master Sergeant (E-9) Promotions Senior Master Sergeant and Chief Master Sergeant Promotions in the Air Force are made using a combination of WAPS points and a centralized promotion board that reviews the individual promotion record. Only 1% of the Air Force holds the rank of E-9 at any one time, making the process highly competitive. Only 2% of the Air Force hold the rank of E-8. To be eligible for promotion consideration, the member must meet the foll owing TIS/TIG requirements Senior Master Sergeant(E-8) - 11 years TIS and 20 months TIG.Chief Master Sergeant(E-9) - 14 years TIS and 21 months TIG. The WAPS points are the same as used in E-5 through E-7 promotions, except, instead of two promotion tests, there is only one The Air Force Supervisory Examination.The test consists of 100questions and is worth a maximum of 100 points. Stripes for Exceptional Performers (STEP) There is one final avenue for promotion to the ranks of Staff Sergeant (E-5) to Master Sergeant (E-7). Each year, the Air Force releases a limited number ofslots for a STEP promotion. The slots are usually distributed to the various major commands, who then distribute them to the wings. There are generally only two or three STEP allocations given to each wing per year. Wing commanders can then use these allocations to promote outstanding individuals to Staff Sergeant, Technical Sergeant, and Master Sergeant. The stated purpose of the STEP system is to allow w ing (and above) commanders a method to promote individuals who are outstandingperformers but do not score well on promotion tests. However, commanders have wide latitude on when/how to use their specific STEPS allocations. Air Force Promotion Board The biggest factor for Senior Master Sergeant and Chief Master Sergeant promotions, however, is the centralized promotion board. Twice per year, theAir Forceconvenes apromotion board. The board is divided into several panels, with each panel examining the promotion records for specific AFSCs. So everyone eligible for promotion within a given AFSC will have their records scored by the same panel. The board president is always ageneral officer, and each panel consists of two colonels (O-6), and one Chief Master Sergeant (E-9). The panel examines the promotion records, and score them by considering performance, professional competence, leadership, job responsibility, breadth of experience, specific achievements and education. The maximum number of board points that can be awarded is 450, so you can see that the board is the most significant part of Senior Master Sergeant and Chief Master Sergeant promotions.

In another intervention, doctors were required to write an antibiotic justification note. In the third intervention, the researchers used electronic health records data to rank the clinicians by their antibiotics overuse. The clinicians received a monthly email informing them that they were either a top performer or not a top performer. In their shaming email, the low performers were shown how many prescriptions their top-performing peers handed out and were given a link of prescribing guidelines to review.Although the feedback and audit interventions caused an initial change in behavior, the peer shaming email had the longest and most lasting effect on clinicians behavior, suggesting that the need for approval from ones peers can be a mora powerful incentive than other forms of feedback.No one wants to feel like youre being left behind by your colle agues, especially when youre a health care professional in a competitive field.A year after the initial intervention, the peer comparison group remained the only group who still had a statistically significant lowered rate of inappropriate prescriptions being made.
